Terms and conditions for the provision of services by the ColibriPay service

1. Make payments exclusively from a personal bank/wallet to which the User has access.
2. Funds must be Paid in one payment, the whole amount without kopecks.
3. After payment, the User is required to attach a receipt for the transaction in PDF format, clearly showing the sender`s full name and card number. The information on the receipt must match that in the application.
4. The User is given a timer on the payment page, during which they are required to attach the receipt. Otherwise, you risk losing your funds!
5. All incoming cryptocurrency transactions are subject to AML verification.
6. In case of non-compliance with the payment rules, a verification procedure will be requested, and the funds will be frozen for an indefinite period.

1. By registering your account or using the service as a legal entity (we do not accept payments from individual entrepreneurs, LLCs, OJSCs, etc.), the User guarantees that they have reached the age of 18 and are fully capable and competent to accept and comply with these Terms. Persons who have not reached the age of majority have the right to view the current website, but cannot order services. ColibriPay has the right to request documents proving your age at any time.
2. By creating a request for an exchange of electronic currencies (money), the User confirms that they were obtained legally.
3. The User agrees that the request made by them is mandatory and cannot be changed after submitting the request for its fulfillment. Refund requests will only be satisfied for verified users and only if the Service has not yet fulfilled its obligations. Funds are returned to the user`s account minus a 2% Service commission (if CRYPTOCURRENCY) or 10% (if FIAT).
   • If the market rate changes by 0.2% or more, before your transaction is confirmed on the blockchain network, the exchange service has the right to return your funds or exchange the request at the market rate.
4. Once the Service fulfills its obligations and the funds are credited to the User`s account, the transaction is considered complete and is not subject to cancellation or revision. You agree that all orders must go through ColibriPay Payment Processing, which, in itself, does not constitute acceptance of the order by ColibriPay.
5. ColibriPay reserves the right to refuse, terminate, cancel, or modify your order in whole or in part for any reason, even after the order has been confirmed and paid for by the User, with or without notice, and the Service will not be liable to any party for such termination or cancellation.
6. After completing the application form, the User can modify or cancel it only if the "Start Exchange" button has not been clicked.
7. You must pay for the application and attach the payment receipt within 15 minutes after the details are issued. If you pay and upload the receipt after this period, the funds may be lost.
   • If you pay using details not specified by the Service in the payment methods, ColibriPay unilaterally terminates the agreement with you for the provision of services.
8. Payments to bank cards are made using the payment service and can take from 10 to 240 minutes. In rare cases, 24 - 72 hours!
   • Payments to bank cards can be made in installments, up to 4-5 transfers.
9. If the funds are credited to the Service`s accounts after the cancellation of your application, you risk losing your funds.
10. Users must provide the exact account number and other required information. Any transfers to incorrect details caused by errors in the data specified by the user cannot be canceled or changed.
    • The user has 21 days to contact us via the email address specified when creating the application. This is necessary to provide all the required information. Otherwise, the funds will be frozen and are non-refundable!
11. If the order is rejected, terminated, or canceled by the Service, any payment you made for the order will be refunded. The Service reserves the right to limit your order or the number of your requests.
12. The Service reserves the right to refuse service to certain individuals or legal entities at its discretion, with or without explanation.
    • The Service reserves the right to conduct selective verification of users before making an exchange on the Site. However, it is worth noting that participation in this procedure is not mandatory, and any client can refuse it without any consequences.
13. If the User is unable to transfer funds in the exact amount specified in the order, less all fees, the Service may, at its sole discretion:
    • reduce the order to the amount of funds received;
    • create a new order for the net amount of funds received at the exchange rate in effect at the time of entering the new order;
    • cancel the order as specified, less all fees.
14. If the User transfers more funds than are necessary to fulfill the order, less all fees, the Service may, at its sole discretion:
    • adjust the order in accordance with the exact amount of funds received;
    • create a new order for the amount of excess funds received at the exchange rate in effect at the time of creating the new order;
    • return the excess funds received to the User, less All fees.

    Money transfers are final and irreversible, except as otherwise provided in the terms.

15. We recommend that our Users provide a valid phone number so that Service employees can contact you if they have any additional questions. We reserve the right to cancel pending orders if we are unable to contact you regarding a disputed order.
    • Dear Users, when submitting a request, we strongly recommend that you provide a valid email address to which you have access. When reviewing any disputes regarding your request, we will request all information sent to you by email from our service; this email contains all the details regarding your request. We are ready to provide you with all the necessary information to resolve any issues that may arise. However, if you do not have access to your email and are unable to provide us with the details of your application, we will not be able to assist you with your questions. This is very important, so please take this point very seriously.
16. The Service is not responsible for delays or failures in the transmission, receipt, or fulfillment of orders, money transfers, payments, or information due to events or systems beyond its control. The owners, employees, agents, or affiliates of the Service are not responsible for any loss or damage arising from any event or system beyond its control.
    • The exchange service may request all required documents to confirm your payment, including a receipt, a PDF statement, and a video recording from your bank account.
17. Payment dispute resolution - from 10:00 to 22:00 Moscow time
18. If funds are received from other people whose names are not specified in the application, we will directly reject your order.
19. The User is responsible for protecting the User`s passphrase. In the event of loss or misuse of the Passphrase by the User, the Service disclaims all liability for such loss.
20. The User is solely responsible for providing true and accurate information necessary to fulfill orders.

We may, at our sole discretion, change, modify, add, or remove any terms and conditions of these Terms and/or the Services at any time without prior written notice. In the event of any material changes to the Terms, we will make reasonable efforts to post a clear notice on the Services and/or attempt to send you an email (to the extent you have provided us with such an email address) regarding such change. Your continued use of the Services following any change to these Terms constitutes your full and irrevocable acceptance of any such change. If any change to these Terms is unacceptable to you, your only recourse is to discontinue using the Services.

1. If illegal actions are committed against the User by third parties, the Service shall not be liable for any loss or damage.
2. Service The Service is not responsible if the application is delayed or not processed by the bank or payment systems specified by the User in their application. In the event of an error on the part of the bank or payment system, the User agrees to submit claims to the relevant bank or system. The Service undertakes to support the User`s claims by providing relevant documentation. The Service is not responsible for delays or failures in the transmission, receipt, or fulfillment of orders, money transfers, payments, or information due to events or systems beyond its control. The owners, employees, agents, or affiliates of the Service are not liable for any loss or damage resulting from any event or system beyond its control. The User may not harm the Service through illegal actions - hacking the database, fraudulent actions, distributing viruses, or posting third-party materials on the Service. You also may not encourage actions aimed at disrupting the operation of the Service or fraudulent actions against Users. You may not interfere with or disrupt the operation of the Service or the servers or networks hosting the Service, or disobey any laws, rules, requirements, procedures, or policies of such servers or networks.
3. You must promptly notify the Service administration of any changes to your account information, such as your email address and phone number. This can be done in your Account by updating the information you previously provided. If you fail to promptly update your information, the Service will not be liable for any negative consequences resulting from your failure to receive timely notifications and security codes.
4. If you suspect unauthorized use of your account, hacking, or theft of your passwords, you must immediately contact the administration.
5. The User may not use services that allow you to hide your geographic location. At the request of the administration, you must report your location, otherwise your actions may be considered suspicious. The Service, at its sole discretion, may reject the request, not fulfill it, or block the User`s account.
6. The Service disclaims liability if the User visits services or social networks that imitate the address of our service and social media accounts. If you discover fake sites or pages, please notify the Service administrators.
7. If the User refuses to provide additional information or documents, the Service administrator has the right to block the transaction or account until the circumstances are clarified.
8. Our Service undertakes to provide exchange services within a reasonable time frame and in full, in accordance with these Terms of Use.
9. The Service undertakes to provide Users with reliable and timely information about changes in the terms of use or payment methods or the amount of commissions. For your convenience, the commission amount is indicated when submitting an application.

1. To carry out transactions for the purchase or sale of electronic money or cryptocurrency, the Service requests personal data from the User, which it undertakes to store in encrypted form and not transfer to third parties, except for the occurrence situations.
2. The transfer of personal data of clients, as well as details of their transactions, may be transferred in response to an official request received in writing from law enforcement agencies, as well as on the service`s own initiative.
3. We will only be able to collect your personal information if you voluntarily provide it to us. If you choose not to provide us with your personal information or subsequently revoke your consent to our use of your personal information, we will not use it.
